Mathieson v Secretary of State for Work and Pensions (2015) UKSC 47

This case challenged the rules around payments of DLA being withdrawn for disabled children after 84 consecutive days in hospital. The Supreme Court held that this breached Article 14 of the Human Rights Act regarding Prohibition on Discrimination.

This case will create reflection and hopefully change regarding the rules for 16, 17 year-olds and adults who currently have their DLA withdrawn after 28 days in hospital.
