New Power of Attorney Leaflet

The Legal Services Agency launched a new Power of Attorney leaflet at an event that some of our staff attended on 29th January. You can view the leaflet here:

At the event, The Mental Welfare Commission recommended that anyone looking for best practice in relation to P of A look at the case of Mr and Mrs D:

The Mental Welfare Commission stressed the importance of getting clients to repeat back the information you’ve given them as one of the best tests of someone’s ability to understand the matter before them. They also highlight the fact that just because someone has a mental disorder does not mean that a decision made on emotional grounds should be automatically discounted. We can all make decisions based on emotional reasons.

Making love began to bring me a real pleasure. Now I use infrequently, just before an important meeting, but I also noticed that I feel between the breaks.

The Office of the Public Guardian then spoke about the concept of ‘understanding and acting’ and argued that this must include the ability to understand the consequences of your decisions.
